FARGO (KFGO KVRR) – A trial in a civil rights lawsuit between the city of Fargo and an adult entertainment store has been delayed until next year.
Romantix Inc. claims the city’s Land Use Development Code is unconstitutional and violates the First and 14th Amendments.
In a 2022 lawsuit, Romantix accused the city of violating its rights by denying a “change of use” permit, which would allow Romantix to relocate from NP Avenue to a location on Broadway. A bench trial has been scheduled with U.S. District Court Judge Peter Welte for July 15.
The city wants the lawsuit dismissed, claiming Romantix doesn’t have a First Amendment claim because it doesn’t plan to sell books or magazines at the new store.
