FARGO, N.D. (KVRR) – A federal lawsuit against Fargo-based Scheels accuses the retailer of removing older workers from its retirement plan.
The age discrimination suit was filed by U.S. Equal Employment Opportunity Commission.
Jeri Fulgham’s attorneys say she accrued employee stock ownership shares over more than 20 years. After she turned 40 and didn’t meet the requirement of working 1,000 hours in a year, the company allegedly forced her to sell her shares.
When she asked Scheels to revise its age-based divestment policy, Fulgham’s lawyers say they refused.
She resigned from the Scheels Reno, Nevada location in 2022.
The EEOC says the alleged conduct violates the age discrimination in employment act prohibiting employers from treating workers over 40 less favorably because of their age.
