
NEW SALEM, N.D. (KFGO) โ One man is dead after a shootout with Highway Patrol troopers and a county deputy in western North Dakota early Tuesday morning.
The Highway Patrol says a trooper tried to pull a vehicle over in Bismarck around 12:45 a.m., but the driver didnโt stop. The trooper chased the driver onto I-94 heading west.
Another trooper and Morton County deputies joined the pursuit.
The pursuit ended when officers used spike strips near New Salem.
After the suspect car came to a stop, the driver, 43-year-old Nicholas Kirby from Dickinson, began shooting at the officers. Two troopers and a deputy returned fire.
Kirby was killed. A female in the car was not hurt.
The Highway Patrol says the troopers are on standard administrative leave while the state Bureau of Criminal Investigation investigates the shooting.
The Morton County Stateโs Attorney will review the findings of the investigation.
