FARGO (KFGO/KVRR) – The Fargo City Commission has turned down an appeal by the Windbreak over a liquor license violation.
The bar, on I-29 and 32nd Avenue S., will have to pay a $500 penalty.
Police say a 23-year-old woman crashed her car into a pole and was charged with DUI after leaving the bar last July. Staff and a manager are accused of over-serving the woman. She was removed by security at 1 a.m. and was checked on in her car.
The crash took place about an hour later. Her blood alcohol level was .29, three times above the legal limit for driving. It was the first violation for the Windbreak, but City Commissioner Dave Piepkorn believes the bar is on its way to losing its liquor license.
The Windbreak will be the focus of the liquor control board again during a special meeting on Thursday for another case of serving an obviously intoxicated person.
