Supreme Court rejects appeal in medical pot bust

FARGO, N.D. (AP) - The North Dakota Supreme Court has rejected an appeal by a Washington state couple who were caught with medical marijuana.

Brian Kuruc and his wife, Rebecca Larson, of Dickinson, were apprehended last year at a Casselton motel. They entered conditional guilty pleas to possession of marijuana and tampering with physical evidence.

Defense attorneys argued that Kuruc and Larson both had valid pot prescriptions from Washington and the amount of marijuana was under their allowable limits.

The justices said in a ruling released Thursday that a prescription is not a valid defense and they don't believe the Legislature meant to put the state "in the perplexing position'' of recognizing prescriptions that can't be legally obtained by its own citizens.

The court noted that medical marijuana is not legal under federal law.
