Presentence report could influence Cobb sentence

BISMARCK, N.D. (AP) - A white supremacist who unsuccessfully tried to establish an all-white enclave in the North Dakota town of Leith is set to learn his fate for terrorizing residents there.

Craig Cobb is to be sentenced Tuesday after being jailed for nearly half a year. Whether he spends more time behind bars could depend heavily on a presentence investigation that both Cobb and prosecutor Todd Schwarz say is filled with errors.

The two earlier reached a plea deal that included probation and no prison time. But some Leith residents want Cobb to spend more time behind bars. It's unclear what the presentence investigation recommends because it's sealed.

University of North Dakota associate law professor Gregory Gordon says judges rely a lot on presentence investigations because they're supposedly done by a neutral source.
